Terms & Conditions
1. Introduction and Scope
These Terms & Conditions (“Terms”) apply to your use of jonbelmontmusic.com (the “Website”) and to the inquiries and materials you submit through it. The Website is operated under the business name Jon Belmont Music and the professional name Jon Belmont (“Jon Belmont,” “we,” “us,” or “our”).
The Website is a professional portfolio and inquiry site. It does not sell products, licenses or subscriptions, and it does not set the terms of any production project.
By using the Website or submitting an inquiry, you acknowledge these Terms. If you do not agree with them, please do not use the Website or submit an inquiry.
2. Inquiries and Professional Engagements
Submitting an inquiry, sending a message or material, or starting a conversation with us does not create a producer-client relationship or any other professional engagement. It does not oblige Jon Belmont to accept a project, to respond within any particular time, or to work with you. Receiving or reviewing a demo is not acceptance of a project. We may accept or decline an inquiry.
A project exists only once the relevant parties have clearly agreed to it, as described in Section 5.
3. Submitted Music and Creative Materials
You may choose to submit demos, songs, recordings, compositions, lyrics, links or other creative material through the Website. If you do:
- You confirm that you have the right or authority to submit the material, and that you are entitled to share any work of others that it contains.
- You give us only the limited permission reasonably necessary to receive, store, access, listen to and review the material in order to evaluate and respond to your inquiry. This is not a licence to publish, distribute, release or otherwise commercially exploit it.
- You keep ownership of your material. Submitting it does not transfer copyright or any other rights to us.
- Submitting the material, or our receiving or reviewing it, does not create a producer agreement, songwriting agreement, partnership, representation relationship or other professional engagement. It does not oblige us to use the material, to accept the project, or to pay or compensate you for receiving or reviewing it.
As a professional producer and songwriter, we may already be creating or receiving, or may later create or receive, music, ideas, sounds, themes, concepts or production approaches that resemble material you submit. The existence of similar material does not by itself establish that your submitted material was copied. Nothing in this Section gives us a right to copy or commercially exploit your protected work, or waives any copyright claim you may have.
Submissions are handled privately for the purpose of evaluating inquiries, as explained in our Privacy Policy. Submitting material through the Website does not by itself create a non-disclosure agreement or a confidential relationship, and we cannot guarantee absolute confidentiality. We do not intend to publish, disclose or exploit unreleased submissions. If your material is particularly sensitive, please contact us before submitting it.
4. Privacy
Our Privacy Policy explains how personal data and submitted materials are collected, stored and used. It is not repeated in these Terms.
5. Professional Projects and Separate Agreements
Jon Belmont provides professional services such as production, songwriting and song development, vocal production, recording and engineering, and mixing. Any specific engagement, including its scope, fees, schedule, deliverables, rights, credits, confidentiality, and governing law or dispute terms, is determined by a separate agreement or mutually agreed project terms between the relevant parties. These Terms are not a producer, songwriting, mixing or other project agreement and do not set commercial terms for any project.
No ownership of, or interest in, any composition, sound recording, publishing, master, songwriting share, producer royalty or similar right is assumed, granted or waived merely because an inquiry, session or conversation took place. Rights are determined by the applicable agreements and circumstances.
Material exchanged within an established professional project may be subject to confidentiality obligations or understandings that apply to that project. If a separate project agreement conflicts with these Terms in relation to that project, the project agreement governs.
6. Website Content and Third-Party Rights
Jon Belmont’s own branding, logo, website design, original text and graphics, and other content that Jon Belmont owns or has the right to use, are protected by applicable intellectual property laws. You may not reproduce, distribute, modify or commercially exploit that content without permission, except where permitted by law.
Album and single artwork, artist names, music, recordings, trademarks and logos, including those of Spotify, Apple Music and Instagram, and other third-party material shown or referred to on the Website belong to their respective owners. They appear to identify Jon Belmont’s professional work and credits, and no ownership, endorsement or affiliation is claimed or implied.
If you believe that material on the Website infringes your rights, or you would like something corrected, please contact hello@jonbelmontmusic.com.
7. Portfolio and Credits
The Website may identify publicly released projects and professional credits associated with Jon Belmont’s work. Credits are summarized for portfolio purposes. They are not a complete statement of every contributor or rights holder associated with a release, and they do not describe the rights, ownership or terms of any project. The form and placement of credit for a project, and any related obligations, are matters for that project’s agreement.
8. Acceptable Use
You may not use the Website or the inquiry form to:
- Infringe another person’s intellectual property rights or submit material you have no right to submit;
- Attempt to gain unauthorized access to the Website or related systems;
- Upload malware, send automated or abusive submissions, or otherwise interfere with the Website;
- Misrepresent your identity or your authority to act for another person or organization; or
- Engage in unlawful activity.
We may decline submissions or restrict access where reasonably necessary to protect the Website.
9. Third-Party Links and Services
The Website links to third-party services such as Spotify, Apple Music and Instagram. We do not control them, and linking to them does not imply affiliation, sponsorship or endorsement. Their content, availability and privacy practices are their own, and their own terms and policies apply when you use them.
10. No Guarantee of Results
Website information, communications and inquiries do not guarantee acceptance of a project, a professional engagement, a release, commercial success or any career result. Past work and credits do not guarantee future results.
11. Website Availability, Accuracy and Liability
The Website is provided “as is” and “as available.” We aim to keep it accurate and available, but we do not guarantee uninterrupted access, or that its information, including credits and release details, is always complete, current or error-free.
Except where liability cannot lawfully be excluded or limited, including liability for intent or gross negligence and your rights under mandatory consumer law, Jon Belmont is not liable for indirect or consequential loss arising from your use of the Website or the inquiry process. Liability relating to a project is governed by the applicable project agreement, where one exists.
12. Changes to the Website and Terms
We may change, suspend or discontinue parts of the Website. We may update these Terms for future use of the Website and will revise the “Last Updated” date when we do. Continuing to use the Website after an update means you acknowledge the revised Terms, to the extent permitted by applicable law.
Updating these Terms does not change or rewrite any separate agreement for a producer or other project, which continues to be governed by its own terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to applicable conflict-of-law principles. Any dispute arising from these Terms will be subject to the jurisdiction of the competent courts of Sweden, except where mandatory applicable law provides otherwise.
Separate project agreements may establish their own governing law, jurisdiction or dispute terms, which will apply to the project concerned.
